Legal experts divided over Speaker's response

Kathmandu, March 10: Legal experts are divided over a letter sent by Speaker Onsari Gharti to the Judicial Council, seeking a review on its recommendations for appointment of justices for the Supreme Court.  

Speaking at a programme organised in the capital Thursday, legal practitioners expressed differing views regarding the Speaker's move.
Nepal Bar Association former President Prem Bahadur Khadka said it was not right for JC, incomplete with 40 per cent membership lying vacant, recommending the name for SC justices.

Legal expert Ram Narayan Bidari urged the bodies concerned not to give political colour to step taken by the Speaker, as it was a legal move.

JC former member Khem Narayan Dhungana said the issue was a constitutional matter and its solution should be sought by amending the constitution.

It may be noted that Speaker Gharti  on Sunday sent the recommendations for appointment of 11 SC justices back to the JC for a review. The JC had made the recommendations for the mandatory parliamentary hearing. RSS
